2 About Our Service

HomeAndBathSolutions.com is a lead generation and contractor matching platform operated by Lead Cactus LLC. We connect consumers seeking home improvement services — including roofing, solar panels, window replacement, bathroom remodeling, and related trades — with licensed local contractors.

        Important: We are not a contractor. Lead Cactus LLC does not perform any home improvement work. All matched contractors are independent professionals. We make no warranty regarding their licensing, insurance, quality of work, or fitness for your project.
      

3 Lead Generation — How It Works

Full Request Forms: When you complete a full service request form, your contact information and project details are shared with one or more contractors in our network. Those contractors will contact you directly. Submitting a form does not guarantee contractor availability, response time, or project completion.

Redirect Forms: Some forms on our site redirect you to a third-party partner's website upon submission. Once redirected, that partner's own terms of use and privacy policy govern your interaction. We are not responsible for any third-party site's practices or content.

By submitting any form on this Site, you acknowledge that:

You may be contacted by multiple contractors
Contractors are independent and not employees of Lead Cactus LLC
We do not guarantee project outcomes, pricing, or contractor conduct

4 TCPA Consent & Communications

        TCPA Consent: By providing your phone number and submitting a form on this Site, you expressly consent to receive calls, text messages, and pre-recorded or automated messages from Lead Cactus LLC and its contractor partners at the number provided, including via an automatic telephone dialing system. Consent is not a condition of any purchase or service.

5 User Eligibility

You must be at least 18 years old to use this Site
You must be a United States resident
You agree that all information you submit is accurate, current, and truthful
You may not use this Site on behalf of another person without their express authorization

6 Prohibited Uses

You agree not to:

Use the Site for any unlawful or fraudulent purpose
Submit false, misleading, or incomplete information
Use automated tools, bots, scrapers, or crawlers on the Site
Attempt to gain unauthorized access to any part of our systems or infrastructure
Resell, redistribute, or commercially exploit any lead data or contact information obtained through this Site

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that any contractor match will result in a completed project, competitive pricing, proper licensing, adequate insurance, or satisfactory workmanship. We are not liable for any contractor's performance, estimates, conduct, or failure to perform.

10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEAD CACTUS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for any claim arising from or related to these Terms or your use of the Site shall not exceed $100.00 USD.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11 Indemnification

You agree to indemnify, defend, and hold harmless Lead Cactus LLC, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your submission of false or misleading information; or (d) your violation of any applicable law or the rights of any third party.

12 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration. All disputes must be brought on an individual basis only.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
